New regulations for trademark registration cancellation (nullity) and non-use cancellation
The regulation that allows the National Institute of Industrial Property (INPI) to resolve, at the administrative level, cancellation (nullity) and non-use cancellation of trademark registrations (Resolution 279/2019), was approved today.

The new procedure will take effect on December 9, 2019 and will affect trademark registrations “granted more than five years ago” that have not been used (regarding non-use cancellations) and, those wherein "some not rectifiable serious defect in the registration procedure" has been found (regarding cancellation -nullity-).
