Important changes concerning Patent formalities in Argentina

Reinstatement of the requirement of submitting a Certified Spanish Translation of the priority document


As you may recall on, January 12, the Argentine government issued decree No. 27/2018 which among other changes established that it was no longer mandatory to file a certified copy of the priority document and its translation within 90 days from the filing date, unless the examiner explicitly requested it.

Unfortunately, the ARPTO has gone back on this decision and recently published a notice establishing that all applicants who filed applications between January 12, 2018 and October 1, 2018 should now submit a certified translation from a local translator of the priority (s) invoked within a period of 3 months. We have contacted the Patent Office and they informed us that it is not necessary to submit the original certified copy of the priority, a scanned copy will be sufficient.
